Booking Conditions

BOOKING CONDITIONS & PAYMENT TERMS

1. The Contract

1.1 A contract shall be deemed to have been made between [Company Name] (“Seller”) and the ticket buyer (“Buyer”) when the Buyer has confirmed in writing acceptance of the Seller’s offer to sell tickets. An email from the Buyer to the Seller shall be deemed such acceptance.

1.2 All tickets sold by the Seller to the Buyer are subject to these terms and conditions which can only be varied if agreed in writing by an authorised representative of the Seller.

2. Price

2.1 All ticket prices quoted on the Seller’s website are inclusive of delivery by registered post. Additional delivery costs may be due according to the location and requirements of the Buyer.

3. The Buyer

The Buyer is responsible for registering his or her correct personal details (including name and address) on the Seller’s website.

3.1 The Buyer must be aged 18 or over.

3.2 The Buyer agrees that the Seller can provide the Buyer’s name, address and contact details to the management or officials of the All England Lawn Tennis Club if required.

4. Payment

4.1 Full payment for all tickets purchased must be made by the Buyer immediately upon making the booking.

4.2 The Seller will not despatch any tickets to the Buyer until full payment has been
received in clear funds

4.3 Once a booking has been made tickets cannot be exchanged or refunded other than at the absolute discretion of the Seller. Failure by the Buyer to make full payment for the tickets within 3 working days will be a breach of contract entitling the Seller to terminate the contract and reallocate the tickets for sale to other parties without informing the Buyer.

5. Cancellation by the Buyer

5.1 Once payment has been received by the Seller no refund will be available to the Buyer.

6. Ticket Prices and Availability

6.1 All advertised tickets are subject to availability and the Seller has the right to change the price of any ticket at any time prior to a booking being accepted.

7. Liability of the Seller

7.1 The Buyer acknowledges that the maximum liability of the Seller for a failure in delivering the tickets will be the price paid by the Buyer for those tickets.

7.2 Notwithstanding anything to the contrary in these terms and conditions the Seller shall not be liable to the Buyer for any indirect or consequential loss or damage arising out of or in connection with the performance or any breach of contract with the Buyer and the maximum liability of the Seller to the Buyer in aggregate for all and any claims made against the Seller under or in connection with the subject matters of the contract shall not exceed the total price paid for the tickets by the Buyer to the Seller.

7.3 The Seller will not be liable for any loss or damage suffered or sustained to property or belongings of the Buyer or any of the Buyer’s guests or for any further costs demands or expenses incurred or suffered by the Buyer arising out of the booking.

7.4 Nothing in this Clause 7 shall operate to exclude liability for death or personal injury resulting from the negligence of the Seller.

7.5 If the event for the booked ticket is cancelled, postponed or subject to restricted playing times for any reason, including inclement weather, national emergency, outbreak of war, prohibitive government regulations, strikes, consequences of terrorism or any other cause beyond the reasonable control of the Seller, the Seller shall not be liable to the Buyer and no refunds will be made.

8. Delivery and Risk

8.1 Risk of damage or loss to the tickets shall pass to the Buyer at the time of signed receipt for the Seller’s letter to the Buyer enclosing the tickets.

8.2 Once risk of damage to or loss of the tickets has passed to the Buyer in accordance with Clause 8.1 the Seller shall not be liable to replace any lost or damaged tickets.

9. General

9.1 The contract and these terms and conditions shall be governed by English Law and the Seller and the Buyer hereby submit to the exclusive jurisdiction of the English Courts in all matters regarding any dispute or otherwise relating to these terms and conditions or purchase of the tickets.

9.2 Any person not a party to this contract shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of the contract or these conditions.
